In the Future Shopper Report 2023, consumer research shows that roughly one in six in-store shoppers cite ‘trust/authenticity’ as a primary reason they don’t buy online. That’s not a trivial number. When 16 percent of potential offline customers question whether what they’re buying is genuine, properly labeled, or offered by a retailer willing to stand behind it, the entire category risks stagnation or collapse.

That hesitation doesn’t happen by accident. Illicit products, from unauthorized imports to mislabeled shipments and outright counterfeits, are flooding through distribution channels. A recent Reuters investigation found nearly a 90 percent mismatch between U.S. import records and partner nations, underscoring just how much product may be entering under false declarations.

These middlemen, including customs brokers, distributors, and brokers operating from residential addresses, enable and amplify illicit supply chains that evade scrutiny. In short, rogue players are creating noise and leverage precisely where consumer confidence should stand firm.

Enforcement Has Arrived and It’s Now Nonnegotiable

The industry has asked, and the regulators have now answered: they will no longer issue polite reminders. It’s about action. In a recent FDA and CBP joint operation, authorities seized nearly $34 million worth of illegal e-cigarette products. Many shipments had vague labeling or incorrect information, indicating an attempt to evade customs controls or other regulatory reviews.

FDA Commissioner Marty Makary has taken a step further, making it clear in his recent statement that retailers can no longer turn a blind eye. Too many have willfully sold unauthorized products, and his message leaves no room for doubt: this is no longer a gentle reminder; it’s a warning. To drive home the point, the FDA is mailing materials to more than 300,000 retailers. Those packets include the 20 nicotine pouch products that can be legally marketed in the U.S., access to the new Searchable Tobacco Product Database, and fresh education resources to reinforce vendor responsibilities.

Back in July, the commissioner also flagged the porous nature of U.S. ports, calling illicit vapes a kind of “attack” on American youth and pledging stronger seizure powers at the border.

In short, the regulatory pendulum has swung firmly toward enforcement. The question for retailers is whether they take action against illicit products or become collateral in a policy crackdown.
